The Wear Soft

These terms govern your use of thewearsoft.com and any purchase you make from The Wear Soft, a footwear brand based in Pakistan. By browsing the website, creating an account or placing an order, you agree to these terms. If you do not agree, please do not use the website or place an order.

1. Eligibility and Account

You must be at least 18 to place an order. If you are under 18, you may order only with the involvement of a parent or guardian, who accepts responsibility.

You are responsible for keeping your account login confidential and for all activity under your account. We may suspend or close any account used for fraudulent activity, repeated refused deliveries, abusive conduct towards our staff, or any breach of these terms.

2. Products, Images and Sizing

Product photographs are taken in studio lighting. Colours may look different on your screen depending on your device and display settings. Minor variation between the on screen image and the physical product is normal and is not a defect.

Embellishments and natural material grain may vary slightly between pairs. This is a characteristic of the product, not a fault.

Sizing runs from US 5 to US 13, which is EU 35 to EU 43. Please check our size guide before ordering, as an incorrectly selected size is not eligible for replacement.

3. Pricing and Availability

Prices are in Pakistani Rupees and include applicable taxes unless stated otherwise. We may change prices, withdraw products or discontinue any collection at any time. Price changes do not affect confirmed orders.

If an item becomes unavailable after your order is placed, we will contact you to offer an alternative, store credit, or cancellation with a refund where you have already paid. In the event of an obvious pricing or listing error, we may cancel the order and refund any amount paid, after informing you.

4. Orders

Placing an order is an offer to purchase. Your order is accepted only when we confirm it and dispatch the parcel.

We may decline or cancel any order where the product is unavailable, there is a pricing or description error, we cannot verify your address or contact number, the order appears fraudulent, or you have a history of refused cash on delivery orders.

We may call or message you to confirm your order before dispatch. If we cannot reach you, dispatch may be delayed or the order cancelled.

5. Payment

We accept cash on delivery and bank deposit or bank transfer. Bank deposit orders are dispatched only after payment is verified, and are held for 24 hours before automatic cancellation if no payment proof is received.

We never ask for an OTP, card PIN or full card details. If you receive such a request in our name, do not share it and report it to shop@thewearsoft.com.

6. Shipping, Returns and Refunds

Delivery charges, timelines and failed delivery handling are set out in our Shipping Policy. Replacement eligibility, the claim window, required evidence and refund exceptions are set out in our Refund Policy. Both form part of these terms.

In summary, we replace products that are defective from our side or where we shipped the wrong size or article. We do not replace products because of a change of mind or an incorrectly selected size. Risk in the goods passes to you at delivery.

7. Promotions and Discount Codes

Unless stated otherwise, discount codes cannot be combined with another offer, have no cash value, apply while stock lasts, and may be withdrawn at any time. We may cancel any order where a discount code has been obtained or used in a manner not intended.

8. Intellectual Property and Customer Content

All content on thewearsoft.com, including our brand name, logo, product photographs, designs and text, is our property and is protected by law. You may not copy, republish or use it commercially without our written permission. This includes using our product photographs to sell on any other platform, marketplace or social media page.

If you submit a review, photograph or video to us, or tag us publicly, you grant us a non exclusive, royalty free right to use and display that content in our marketing, with credit where practical. You confirm the content is your own and does not infringe anyone else's rights. We may remove any submitted content at our discretion.

9. Acceptable Use

You agree not to place fraudulent or abusive orders, interfere with the website's operation or security, attempt unauthorised access, scrape data using automated tools, post unlawful or offensive content, or impersonate The Wear Soft or our staff.

10. Third Party Links

Our website and social channels may link to third party sites, including courier tracking and payment providers. We do not control them and are not responsible for their content or practices.

11. Disclaimer and Liability

The website is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted or error free.

Footwear is subject to normal wear. We do not warrant that a product will remain unaffected by ordinary use, misuse, improper storage, or exposure to water, heat or chemicals.

To the fullest extent permitted by law, we are not liable for any indirect or consequential loss, including loss of profit or loss arising from delayed delivery. Our total liability for any order shall not exceed the amount you paid for that order. Nothing here excludes liability that cannot lawfully be excluded.

We are not liable for delays caused by events outside our control, including natural disasters, extreme weather, strikes, civil unrest, courier or network failures, power outages or government restrictions.

12. Privacy

Your personal information is handled in accordance with our Privacy Policy, which forms part of these terms.

13. Governing Law

These terms are governed by the laws of the Islamic Republic of Pakistan. Any dispute shall be subject to the exclusive jurisdiction of the courts of Pakistan.

14. Changes and Contact

We may update these terms. The revised version will be posted here with a new "Last updated" date. The terms that apply to your order are those in force when the order is placed.
